Drug Trafficking Penalties in Florida

The penalties for trafficking are based on the prior record of the defendant, the quantity of drugs involved, and the type of drug involved. Florida law classifies drugs into five different categories, with Schedule I being the most addictive with the most serious penalties.

These are sentencing guidelines for some of the most serious drugs: 

• Heroin: A defendant charged with trafficking at least 4 games can face three years in prison and a $50,000 fine. If the quantity reaches 30 kilograms, the fine could go to $500,00, and the prison sentence can be for life. 
• Cocaine: The minimum quantity is 28 grams and, like heroin, can result in three years’ jail time and a fine of $50K. If the amount trafficked gets up between 400 grams and 150 kilograms, defendants are looking at 15 years in prison and a $250,000 fine. 
• LSD: The combination of three years in prison and a $50,000 fine can happen with just a single gram of LSD trafficked. Five grams can lead to seven years behind bars and a fine of $100,000. 
• Ecstasy: By trafficking even 10 grams of ecstasy, defendants risk three years behind bars and a fine of $50,000. They could face a jail sentence of 15 years and a $250,000 fine for trafficking upwards of 400 grams. 

Those are just a handful of examples, but they underscore the basic principle—the higher the quantity and the more serious the drug, the higher the potential fine and jail sentence. In certain cases, such as cocaine trafficking, the death penalty can be sought if someone was killed in the process.
