Felony Penalties in Florida
Florida law divides felonies into five distinct categories, based on the seriousness of the offense and the defendant’s prior record. Each category has its own sentencing guidelines.
Felony classes and their possible sanctions are as follows, in escalating order of gravity:
- 3rd-degree felony: An example might be burglary where the defendant was unarmed and did not cause injury to anyone. Even this lowest rung of the felony charge ladder can result in a jail sentence as long as five years, and a fine of up to $5,000.
- 2nd-degree felony: These charges often include cases where a deadly weapon was involved. Another example is extortion or vehicular homicide. The prison sentence in the event of a guilty verdict can be as long as 15 years, with the fine potentially reaching $10,000.
- 1st-degree felony: Deadly weapon cases can still apply here, as can charges of aggravated assault on a child or law enforcement officer. Judges are authorized to sentence defendants to up to 30 years in jail in the event of a conviction.
- Life felony: Sex crimes against children, along with human trafficking, can fall into this category. As the name of this category suggests, defendants are at risk of life behind bars.
- Capital felonies: Potential capital crimes in Florida, where the death penalty is possible, include murder, along with certain cases of drug trafficking and kidnapping. Crimes that resulted in death may also, depending on the circumstances, be considered capital.
Possible Felony Charge Defenses

Broadly speaking, however, several strategies and approaches can be used, including these:
