The Penalties for Misdemeanors in Florida

The state of Florida breaks misdemeanors down into just two categories:

1st Degree Misdemeanors

1st-degree misdemeanors in Florida involve offenses like DUI (Driving Under the Influence), some domestic violence cases, and certain theft charges. Convictions for 1st-degree misdemeanors can result in penalties that include fines of up to $1,000 and potentially a full year of jail time. Probation and community service are also possible consequences.

2nd Degree Misdemeanors

Second-degree misdemeanors encompass offenses such as simple assault, petty theft, and possession of small amounts of certain drugs. Those convicted can face penalties that include fines of up to $500, probation, community service, and jail time of up to 60 days.

Aggravating Factors

Every case is a little bit different, and there are circumstances where an allegation that would normally be a misdemeanor could be enhanced into a felony:

  • Use of a deadly weapon during the commission of the misdemeanor offense
  • Previous criminal history
  • Infliction of serious bodily harm or injury to another person
  • Offenses committed in the presence of a minor
  • Crimes against a vulnerable victim (children, the elderly, the disabled, etc.)
  • Violation of protective orders or court injunctions

Do You Plea Bargain or Go to Trial?

There are circumstances where a District Attorney may offer a defendant the possibility of reduced charges or lighter sentencing in exchange for a guilty plea. Should defendants take the deal, or should they go to trial?

The counsel of our Orlando misdemeanor defense lawyer can and should be sought. We’ll evaluate the full circumstances of the case. How much evidence does the prosecution have? What are the potential defenses available that could raise reasonable doubt in the minds of the jury? Every case is different.

Attorney Mills isn’t afraid to go to trial. He has extensive experience in court. Furthermore, as a former prosecutor himself, he also understands how to seek out weaknesses in the evidence against defendants and leverage that in a court of law. No one can guarantee an outcome or even what the recommended path will be in any specific case. What we can tell you is that we aren’t scared of going toe-to-toe with prosecutors and making your defense to a jury of twelve people.
